Congratulations to Academy of Our Lady of Peace, and Dalton & Tomich attorneys as they secure a $1.1 Million jury verdict against the City of San Diego. After a two week trial in the U.S. District Court for the Southern District of California in San Diego, the jury found that the City Council’s March 2009 decision to deny two permits the Academy needed in order to complete a project to modernize its historic 80-year-old campus created a Substantial Burden and was in violation of the Religous Land Use and Institutionalized Persons Act (RLUIPA) while awarding $1.1 Million in damages. The Court will rule on additional injunctive relief in November. More details to come.
